Welcome to Lost Tune Journey. This User Agreement (the “Agreement”) governs your access to and use of Lost Tune Journey and all associated services, content, features, and software provided by us. By accessing or using Lost Tune Journey, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you must immediately discontinue use of Lost Tune Journey. By downloading, installing, or using Lost Tune Journey, you accept and agree to be bound by the terms and conditions set forth in this Agreement. This Agreement governs your use of the services provided within the application and any updates, enhancements, or modifications to the application that may be released from time to time. Your access to and use of Lost Tune Journey is also governed by our Privacy Policy available at safepoint.html, which is incorporated into this Agreement by reference. You agree to comply with all applicable laws and regulations regarding your use of the application.
We reserve the right to modify or update this Agreement at any time for any reason. Changes to the Agreement will be effective immediately upon posting. Your continued use of Lost Tune Journey following the posting of changes constitutes your acceptance of those changes. It is your responsibility to review this Agreement periodically to stay informed of any modifications. If you do not agree to the updated terms, you must stop using Lost Tune Journey.
You represent and warrant that you are of legal age to form a binding contract and are not restricted from using Lost Tune Journey by any law or regulation. If you are accessing Lost Tune Journey on behalf of an organization, you represent that you have the authority to bind that organization to this Agreement. By using Lost Tune Journey, you affirm that you meet all eligibility requirements and will comply with all terms and conditions set forth in this Agreement.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Lost Tune Journey on your compatible devices solely for your personal, non-commercial use. You agree not to use the application for any purpose that is unlawful or prohibited by this Agreement. You may not copy, modify, distribute, sell, lease, or exploit any part of Lost Tune Journey without our prior written consent.
In order to access certain features of Lost Tune Journey, you may be required to create an account. You agree to provide accurate, current, and complete information when creating your account and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Some features of Lost Tune Journey may allow you to post, submit, or share content, including but not limited to text, images, and other materials (“User Content”). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the operation of Lost Tune Journey and our business. You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third-party rights or applicable laws.
When using Lost Tune Journey, you agree not to: (a) engage in any activity that violates this Agreement or any applicable law; (b) use cheats, automation, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the application; (c) harass, abuse, or harm another person or group; (d) transmit any content that is defamatory, obscene, or otherwise objectionable; (e) attempt to gain unauthorized access to the application, servers, or networks connected to Lost Tune Journey; or (f) engage in any conduct that could damage, disable, overburden, or impair the application or its users’ enjoyment of it.
Lost Tune Journey may offer in-app purchases or virtual items for use in the game. All purchases are final and non-refundable except as required by applicable law. Virtual items have no monetary value and cannot be redeemed for cash. We reserve the right to modify, remove, or alter in-app purchases and virtual items at any time without notice. You agree that we are not liable for any losses or damages resulting from changes to the availability or functionality of in-app purchases or virtual items.
We may suspend or terminate your access to Lost Tune Journey at any time, with or without cause, and with or without notice. Upon termination, your right to use Lost Tune Journey will immediately cease. You agree that we will not be liable to you or any third party for any termination or suspension of access to the application. Sections of this Agreement that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
To the fullest extent permitted by applicable law, Lost Tune Journey is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the application will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Your use of Lost Tune Journey is at your sole risk.
To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with this Agreement or your use of Lost Tune Journey, even if advised of the possibility of such damages. Our total liability for any claim arising from or relating to this Agreement or your use of Lost Tune Journey shall not exceed the amount paid by you, if any, for accessing the application.
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of Lost Tune Journey, your User Content, your violation of this Agreement, or your violation of any rights of another party.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which we are established, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction to resolve any dispute arising out of or relating to this Agreement or your use of Lost Tune Journey.
This Agreement, together with our Privacy Policy at safepoint.html, constitutes the entire agreement between you and us regarding the subject matter hereof and supersedes all prior or contemporaneous understandings, agreements, or representations, written or oral, regarding such subject matter. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
